HAULPAY Is a product developed and operated by COMFREIGHT, INC. (“ComFreight”, “the Company”, “we”, “us”) is sensitive to your concerns regarding how we use the personal information we collect from you (and / or your business organization) through our website (the "Site") and other devices involved in exchanging information with us (and other users of our Site). Our Site and Applications are sometimes collectively referred to as "Online Services" for purposes of simplicity. ComFreight takes your privacy seriously, and has implemented this privacy policy (the "Privacy Policy") and other internal measures and practices to keep your personal and financial information secure. The Privacy Policy covers ComFreight’s treatment of the Personally Identifiable Information we collect when you access our Online Services. This Privacy Policy is incorporated into our Terms of Service, and therefore governs your use of the Online Services. Traffic Data.&nbsp ComFreight uses a number of internal and third party methods to recognize visitor data such as IP addresses and browser settings (collectively "Visitor Data"). ComFreight’s internal servers and software automatically recognize Visitor Data. No Personally Identifiable Information is revealed during this process. The Site may use Visitor Data to compile traffic data regarding the types of visitors who access the Site at specific intervals (collectively "Traffic Data").

ComFreight may use the standard cookie feature of major browser applications and third-party providers, or employ internally developed cookies and tracking codes, that allow the Company to store a small piece of data on a visitor's computer, or any other device a visitor uses to access our Online Services, about his or her visit to the Site or use of Applications. ComFreight does not capture Personally Identifiable Information in cookies nor does it use cookies to mine Personally Identifiable Information.

We may use Traffic Data to analyze Site traffic, but this information is not examined for Personally Identifiable Information. We may also use Traffic Data to diagnose potential issues with our servers, administration & maintenance to our Site, or to display content according to your preferences. Visitor Data and Traffic Data may also be shared with business partners, affiliates, or advertisers but only on an aggregated and anonymous basis.

Personal Information.&nbspComFreight requires each user to provide us with personal information (collectively "Personally Identifiable Information") to access and use its products and services. Personally Identifiable Information is captured only when a visitor accesses Online Services, or speaks on the phone with a ComFreight employee, and willingly discloses such information. This disclosure may occur when a visitor registers with an Online Service, engages in transactions, contacts Company personnel, or participates in contests, promotions, surveys, forums, content submissions, chats, bulletin boards, discussion groups, requests for suggestions, or other aspects of services offered by ComFreight.

Personally Identifiable Information includes: (i) "Contact Data" (such as your name, address, city, state, zip code, phone number, and email address); (ii) "Financial Data" (such as your credit card number, expiration date, and verification code); (iii) "Demographic Data" (such as your zip code); and (iv) other "Legal Data" (such as organization’s tax identification number, equipment information, transportation licensure and proof of adequate bonding and insurance coverage’s).

Certain personal information becomes public record when documents are filed with the federal or state government, or with a court. For example, a corporation's name, business address, and registered agent name become public information when its articles of incorporation are filed. A Secretary of State may publish this information to its website or provide this information to third parties for a fee. The U.S. Patent and Trademark Office publishes the names and addresses of trademark registrants. In some states, fictitious business names, including the name and address of the business owner, must be published in a newspaper. ComFreight’s Privacy Policy does not cover these or similar third-party actions.

Calls/Electronic Communications.&nbspIn the regular course of our business, ComFreight may monitor and record phone conversations or email communications between you and its Company personnel for training and quality assurance purposes. We may receive a confirmation when you open or click on content in an email from us, which helps us make our communications to you more useful and interesting. If you do not wish to receive email from ComFreight, you may unsubscribe from our mailing list for any of the emails we send.

We use information we collect from the Online Services to communicate with you, process your orders, facilitate your transactions with our third-party business partners, and inform you of offers and discounts. For example, you may receive a welcome email that confirms your username and password, and later receive communications responding to your inquiries, providing services you request, and managing your account. We occasionally send service-related announcements, for example, to alert you if we need to temporarily suspend the Site for maintenance. We send promotional emails and newsletters from time to time to our users and those who have opted in to receive such emails. Generally, you may not opt-out of service-related communications, which are not promotional. If you do not wish to receive service-related communications, you may terminate your account by contacting us.

We share customer information with third parties only as follows:

Use of Personal Information.&nbspComFreight, sometimes with the assistance of a third party or one of its subsidiaries, may use your Personally Identifiable Information to process your payment through secured merchant account services, to generate the products and services you order, and to analyze our customer demographics. Your Contact Data may be used to follow up with you on transactions you initiate through Online Services, respond to inquiries made through Online Services, inform you of changes to Online Services, and send you additional information about ComFreight and its products and services. Unless specifically authorized by you, we do not provide Personally Identifiable Information to third parties for marketing purposes. We may provide information to a third party in response to a subpoena or to otherwise comply with the law.

Contact Data and Traffic Data are used to gather general statistics about our customers and visitors. We may use Demographic Data to generate collective information about our users, but not in a way that identifies any user specifically. For example, we may inform third parties about the number of registered users and unique visitors, and the pages most frequently browsed.

Service Providers.&nbsp We may share your Personally Identifiable Information with companies that provide support services to us (such as a printer or email service provider) or that help us market our products and services. These companies may need information about you in order to perform their functions. These companies are not authorized to use the information we share with them for any other purpose.

Opting Out.&nbspYou may choose not to provide ComFreight with Personally Identifiable Information or you may turn off cookies in your browser by changing its settings. If you make these decisions, you may continue to use the Online Services and browse its pages. However, ComFreight will be unable to accept any posts without such Personally Identifiable Information.

If you do not wish to receive promotional materials from ComFreight, you may unsubscribe from our mailing list on any materials we send. Generally, you may not opt-out of service-related communications, which are not promotional. If you do not wish to receive service-related communications, you may terminate your account.

Website Areas Beyond ComFreight’s Control.&nbspThe Site may include interactive forums, such as message boards and chat rooms. Any Personally Identifiable Information disclosed in these areas is public and becomes public information. You should use caution when deciding whether to disclose your personal information in these forums.

Other Transfers.&nbspWe may share Personally Identifiable Information and other data with businesses controlling, controlled by, or under common control with ComFreight. If ComFreight is merged, acquired, or sold, or if some or all of our assets or equity are transferred, we may disclose or transfer Personally Identifiable Information and other data in connection with these associated transactions.

Bankruptcy.&nbspIn the event of a ComFreight bankruptcy, insolvency, reorganization, receivership, or assignment for the benefit of creditors, or the application of laws or equitable principles affecting creditors' rights generally, we may not be able to control how your personal information is treated, transferred, or used. If such an event occurs, your Personally Identifiable Information may be treated like any other ComFreight asset and sold, transferred, or shared with third parties, or used in ways not contemplated or permitted under this Privacy Policy, without notice to you or your consent.

Third-Party Websites and Third-Party Service Providers.&nbspComFreight may maintain links to other websites and other websites may maintain links to the Online Services. This Privacy Policy applies only to ComFreight and not to other websites accessible through your use to access ComFreight, each of which may have privacy policies materially different from this one. If you visit other websites, ComFreight is not responsible for the privacy practices or content of those sites. It is your responsibility to review the privacy policies of non-ComFreight websites to confirm that you understand and agree with them.

We may work with third-party service providers that we do not own or control. Unless authorized by you, we do not provide your Personally Identifiable Information to any third-party service providers, except as explained in this Privacy Policy.

Service Partners.&nbspWe may share business contact information with other businesses who provide additional services to users and who are under specific written agreement to provide services to users on behalf of ComFreight. This information is gathered upon automatic opt-in at the time of sign up and may be used to offer complementing services through direct solicitation on behalf of our partners.

User Access to Order Information.&nbspComFreight will share with you, or anyone listed as an authorized contact for your account, information regarding your account. This may include information about the nature and status of your postings, information you provided to process your posts, payment information, and contact information. For some products, you may decide to share information about your postings with retained legal counsel. We also may provide information to a third party in response to a subpoena or to otherwise comply with the law.

Our Commitment to Data Security.&nbspWe strive to make certain that our servers and connections incorporate the latest encryption and security devices. We have implemented physical, electronic, and managerial procedures to safeguard and secure the information we collect. Credit card and personal information are transmitted by secure servers. Documents are typically delivered to you via secured email. COMFREIGHT, INC. (also referred to herein as “we” and / or “the Company”) provides a load posting and load matching service to the freight and logistics industry. Users of COMFREIGHT, INC. are subject to the following Terms of Service ("TOS"). By accepting this TOS, your use of the COMFREIGHT, INC. website constitutes your agreement to be bound by all terms, conditions and notices contained herein. We reserve the right, at our sole discretion and with or without notice, to change, modify, add or remove any portion of these TOS, in whole or in part, at any time. If you do not agree to these TOS, you may not access or otherwise utilize our website. We are here to assist, support and do our best to meet your needs and service requests from using our technology and are happy to assist you directly at [email protected] for additional questions or suggestions regarding this TOS or matters related the site’s functionality.

COMFREIGHT, INC. depicts mileage options in a drop-down box for posting empty space from trailers in order to match them with available partial and full loads that may be local to other drivers / carriers / empty trailers. The distances (calibrated in mileage) between cities, states or zip codes is as accurate as possible but COMFREIGHT, INC. is not responsible for any loss of fuel, time or any other type of expenses due to a lack of understanding of the mileage or other distance data used within the service. The mileage is the user’s own duty to verify on routes, load dispatches and general routing information on any loads or orders that may be posted or matched through the COMFREIGHT, INC. site. Users are required to verify all information for a shipper’s address, business or billing address, carrier MC#, carrier cargo insurance, billing or credit information and any other information posted or related online by any user of the site to any other user of the site. It is not COMFREIGHT, INC.’s responsibility to, in any way, verify, check, research or clear any user allowed to post on the site. Users of COMFREIGHT, INC. assume all risk in tendering loads, establishing new business relationships, verifying credit or invoicing of vendors, shippers, carriers, brokers or any users of the site. Users take it upon themselves to research, verify and check all information posted by any other user on the site before taking action to execute or utilize the services of another user that may have been matched or found through the COMFREIGHT, INC. website. COMFREIGHT, INC. does not endorse any claims as to the accuracy of the credit ratings, days-to-pay, licensing, authority and / or insurance information listed and in no way acts as a broker, shipper, carrier, owner-operator bound to it. However, if a user identifies erroneous or false information posted to the site, please contact us.

In order to maintain the best freight matching web service, we must guard against those that may try to take advantage of others or who simply do not follow prescribed rules and industry regulations. If you are submitting content to our site, you warrant and represent that the information is accurate, that you are authorized to submit that information, and that the information content, format and delivery method is appropriate. In order to protect each user, we reserve the absolute right to review, reject or modify the information submitted in our sole and independent discretion. By transferring information, you agree that COMFREIGHT, INC., its affiliates, and assigns are licensed to use, reproduce, display, perform, adapt, modify, distribute, and promote the information in a manner we deem reasonable in our sole and independent judgment. You agree not to reproduce, duplicate, copy, sell trade, resell or exploit (for any commercial purposes), any portion of the service, use of the service, or access to the service.

COMFREIGHT, INC. reserves the right at any time (and from time to time) to modify or discontinue, temporarily or permanently, the service (or any part thereof) with or without notice. We may also impose limits or restrictions on certain services, features or content or restrict your access to parts or our entire site or app without notice. You agree that COMFREIGHT, INC. shall not be liable to you or to any third party for any modification, suspension or discontinuance of the service.

You agree that COMFREIGHT, INC. may, under certain circumstances and without prior notice, immediately terminate your COMFREIGHT, INC. account and access to the service. Cause for such termination shall include, but not be limited to, (a) breaches or violations of this TOS or other incorporated agreements or guidelines, (b) requests by law enforcement or other government agencies, (c) a request by you (self-initiated account termination), (d) discontinuance or material modification to the service (or any part thereof), (e) unexpected technical or security issues or problems, and (f) extended periods of inactivity. Termination of your COMFREIGHT, INC. account includes (a) removal of access to all offerings within the service, (b) deletion of your password and all related information, files and content associated with or inside your account (or any part thereof), and (c) barring further use of the service. Further, you agree that all terminations for cause shall be made in COMFREIGHT, INC.’s sole discretion and that COMFREIGHT, INC. shall not be liable to you or any third-party for any termination of your account or access to the service.

This service may contain links to other independent third-party websites ("linked sites"). These linked sites are provided solely as a convenience to users of the service. Such linked sites are not under COMFREIGHT, INC.‘s control, and COMFREIGHT, INC. is not responsible for and does not endorse the content of such linked sites, including any information or materials contained on such linked sites. COMFREIGHT, INC. maintains an online freight matching and freight consolidation service for use by carriers, brokers, agents and shippers in order to conduct business and communicate with one another. COMFREIGHT, INC. does not handle cash, control users in any way, or arrange for the movement of freight. All such arrangements are made by, and between, the users of the site and any terms and conditions of such freight movement are solely between the carrier and the shipper. No agency, partnership, joint venture, or employee-employer relationship is intended or created by your use of this website or by these TOS. If a dispute arises by or between users, we must be informed. Users agree not to name COMFREIGHT, INC. in any dispute that may arise with other users. You agree to release COMFREIGHT, INC. its officers, subsidiary / parent companies, employees, and agents from all claims, demands and damages, actual and consequential, of every kind and nature, known or unknown, in any way connected with such disputes.
